Iraqi Governing Council Drafts New Constitution!
8/25/2005
Yesterday, the Iraqi Governing Council approved a draft of what will become their new Constitution. The Constitution they drafted is very different from our Constitution, yet some of the underlying principles are similar. Below I will highlight some of the most important sections. I think this constitution will ensure that Iraq has a bright future.
The Preamble makes it clear that the Iraqi people are behind their new constitution, that they will enforce it, and that they are optimistic about their future. It also makes it clear that they are happy to be free from the tryanny of Saddam Husien.
Chapter 1, article 1 and two sets up Islam as the official religion of Iraq, and sets up rule based on democracy.
Article 4 sets up Arabic and Kurdish as official language, and guarantees parents the rights to educate their children as how they see fit.
Article 5 establishes that government officials be elected through national elections by secret ballots, and Article 6 sets up term limits.
Article 7 outlaws groups that advocate racism, terroism, sectarion cleansing, and especially the Baath Party. It also states that the state will be committed to fighting terroisim.
Chapter 2, Article 14 states that every person is created equal in the eyes of the law, and outlaws discrimination because of gender, ethnicity, nationality, origin, color, religion, sect, opinion, or social or economic status.
Article 15 states that everyone has the right to life, and the right to freedom.
Article 17 gives everyone the right to privacy, and guarantees that illegal search and seizure shall not take place.
